Forensic and correctional patients

The Mental Health (Forensic Provisions) Act 1990 allows information sharing and security protocols to be entered in respect of forensic and correctional patients by the Secretary of the Ministry of Health and the Secretary of the Department of Human Services (in respect of juvenile forensic and correctional patients) and the Commissioner of Corrective Services (in respect of adult forensic and correctional patients).

The Memorandum of Understanding between NSW Health and the NSW Police Service established a protocol for access by the NSW Police Service to Newborn Screening Blood Samples (Guthrie blood spots) held by NSW Health.

A number of agreements between NSW and other States have been developed to allow the cross-border transfer of persons covered by mental health legislation.

Interstate agreements concerning civil patients

These agreements allow for the movement of patients detained under the civil provisions of mental health legislation across the borders, specifically:

  • admission of interstate involuntary patients
  • transfer of involuntary patients to and from each jurisdiction
  • recognition of interstate Community Treatment Orders
  • apprehension of absconding civil patients.
