The Mandatory Disease Testing Act 2021 (Act) allows for the mandatory blood testing of a person in circumstances where the person’s bodily fluid has come into contact with a health, emergency or public sector worker as a result of the person's deliberate action and the worker has been placed at risk of contracting a blood borne virus (BBV).

About this document

In accordance with the Act, the Chief Health Officer has issued guidelines to assist:

  • senior officers exercising functions under the Act
  • relevant medical practitioners who may consult with workers for the purposes of the Act
  • persons taking blood from third parties under a mandatory testing order.

Applications for Chief Health Officer review

Workers and third parties may make an application to the Chief Health Officer for review of a senior officer's decision to make or refuse an application for a Mandatory Testing Order. This application, along with supporting documents, must be made within 1 business day of being notified of the senior officer's decision.
